1. Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of the Nuqati mobile application, website, and loyalty platform (the "Services") operated by Nuqati.

By creating an account or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) and capable of entering into a binding agreement to use the Services. You are responsible for ensuring that your use complies with applicable local laws.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate, current, and complete information and to update it as needed.

Notify us immediately at the contact address below if you suspect unauthorized access to your account.

4. Loyalty Program

Nuqati allows members to earn and redeem loyalty points through participating partner businesses, product codes, rewards, and promotional offers.

  • Points have no cash value unless expressly stated and are not transferable except as permitted by the program rules.
  • We and our partners may modify point earning rates, reward availability, and redemption rules at any time with reasonable notice where practicable.
  • Fraudulent activity, misuse of codes, or attempts to manipulate the program may result in forfeiture of points and account suspension.
  • Points may expire according to program rules published in the app or communicated to members.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to systems, accounts, or data.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Use automated means to scrape, harvest, or collect data without permission.
  • Impersonate any person or entity or misrepresent your affiliation.

6. Partner Businesses and Offers

Products, services, and offers from partner businesses are provided by those third parties. We are not responsible for the quality, safety, legality, or fulfillment of third-party goods or services, though we may assist with dispute resolution where appropriate.

7. Intellectual Property

The Services, including the Nuqati name, logos, software, and content, are owned by or licensed to Nuqati and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Nuqati and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Services.

Our total liability for any claim relating to the Services shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or one hundred U.S. dollars (USD 100), where permitted by law.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms, suspected fraud, or operational reasons. You may close your account at any time by contacting support. Provisions that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms are governed by the laws of Iraq, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts located in Iraq, unless mandatory local law provides otherwise.

12. Changes to Terms

We may revise these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
